SDNY COURTHOUSE,
April 26 – Construction
firm Art + 1 is seeking to
settle a class action under
the Fair Labor Standards
Act.
On April 26, U.S. District
Court for the Southern
District of New York
Magistrate Judge Sarah Netburn
held a proceeding. Inner City
Press covered it.
Judge
Netburn expressed concern at a
proposed settlement that would
seem to leave the named
plaintiff in a (much) better
position than the other class
members. The defendant
complained that the
plaintiffs' side would not
meet and confer.
Judge Netburn
told the parties to actually
confer and see if a fair class
settlement can be reached and
if not, to propose by May 6
deadlines for the remainder of
the case.
