SDNY COURTHOUSE,
Aug 11 – Elias Polanco faces a
trial in early 2021 on witness
tampering charges. The
complaint says that Polanco
and his co-defendant conspired
to slash an individual across
the neck in retaliation for
his testimony in a federal
criminal trial.
On August
11 U.S. District Court for the
Southern District of New York
Judge Jed S. Rakoff held a
proceeding. Inner City Press
live tweeted it.
Judge
Rakoff said, "Trials may
re-start in October. This one
could be
December."
Defense lawyer
Camille Abate replied, I'm
babysitting for grandchildren.
Judge Rakoff said, I can
relate, with two young
grandsons. I'll exclude time
until January 4, due to
Coronavirus and defense
counsel's babysitting
obligations.
There will
also be a Wade hearing on
December 16, defined as one on
a motion to suppress proof of
an out of court police
arranged identification of the
defendant. Grounds for this
motion include that the lineup
or photo lineup was held in an
illegal or suggestive manner.
The AUSA
asked, The next conference, in
person?
Judge Rakoff: I hope so.
The case is US v.
Polanco, 19-cr-354 (Rakoff)
