SDNY COURTHOUSE,
May 17 – Kermit Irizarry is
charged with being a felon in
possession of ammunition, to
wit, eight 9mm bullets
manufactured by Speer Products
Co, Sig Saur Inc., and Wolf
Ammunition.
He was identified
by NYPD's ShotSpotter, in The
Bronx, on Christmas Day, 2020.
On
May 17, U.S. District Court
for the Southern District of
New York Judge Mary Kay
Vyskocil held a proceeding.
Inner City Press covered
it.
Irizarry was to
have had a conference in his
case in April, but asked to
adjourn it to review
discovery.
Then a May 13
conference was not possible,
due to the schedule of the
jail in New Jersey, Essex
County Correctional
Facility.
Now Judge
Vyskocil wants to set a trial
date, even as a motion to
dismiss on grand jury issues
pends.
This is because,
as least for now, most of her
trial schedule is not her
own.
She said this
might be a discrete enough
case that trial could be done
without the committee.
She picked
November 12, and excluded time
until then.
