Mathieu 4 Years After Trial Testimony Calls

SDNY COURTHOUSE,
Dec 11 – Paul Mathieu was a
doctor who allowed a
non-doctor, Aleksandr Burman,
to open and run clinics in his
name, and signed false
documents about clients whom
he had never seen. After
conviction in a jury trial in
which he testified, he
belatedly arrived for
sentencing on December 11
before U.S. District Court for
the Southern District Judge
Lorna G. Schofield.
Judge Schofield, who presided
over the trial, imposed a two
point sentencing guideline
enhancement on Mathieu for
what she called perjured
testimony. One question raised
thereby, in terms of
disparities in sentencing, is
the position of fellow SDNY
Judge Jed S. Rakoff, that so
much testimonial penalty
should be imposed.
This
may be only an academic
matter, as Judge Rakoff openly
calls the guidelines
arbitrary, and Judge Schofield
seemed to say that her
ultimate sentence was not
impacted by the guidelines
(but was by the attendance of
Mathieu's friends and
family).
The question of
restitution and loss amount,
after a length discussion, was
deferred. Mathieu spoke,
movingly, and said that all he
ever wanted to be was a
doctor. Judge Schofield
sentenced him to 48 months or
four years, with three years
of Supervised Release to
follow. The case is US v.
Mathieu, 16-cr-763
(Schofield).
