SDNY COURTHOUSE,
Feb 28 – Easy Spirit
sued Sketchers for stealing
its Traveltime trade dress for
Sketchers' "Commute
Time."
On February 26, U.S. District
Court for the Southern
District of New York Judge
William H. Pauley III held a
proceeding. Inner City Press
covered it.
Judge
Pauley had ruled in January
dismissing some claims but
allowing others to proceed.
Still Easy Spirit disputed it.
Now Judge Pauley
has ruled that Sketchers'
requested "motion for
clarification" is not needed;
any motion to amend the
pleading to include claims
regarding Sketchers' Commute
mark would be futile.
The case is Easy
Spirit, LLC v. Skechers
U.S.A., Inc. et al.,
19-cv-3299 (Pauley)
