SDNY COURTHOUSE,
Dec 21 – Richard Rosario sued
the City of New York for
having spent 20 years in jail
unjustly, and now approaches
trial. Unvaccinated people
will be excluded from his
jury, it has
emerged.
On December 21, U.S. District
Court for the Southern
District of New York
Judge Lorna G. Schofield held
a pre-trial conference. Inner
City Press covered
it. The lawyers
expressed worry about the
Omicron variant of COVID-19.
Judge Schofield
said she had been assured that
the trial can be held in one
of the large courtrooms in 40
Foley Square - like the one
Ghislaine Maxwell is on trial
in this week. That jury has at
least one unvaccinated
juror.
But Judge
Schofield, citing fellow judge
Valerie E. Caproni, said she
will strike any unvaccinated
prospective juror for cause.
Still, the lawyers expressed
worry.
The case is
Rosario v. City of New York et
al., 18-cv-4023 (Schofield)
