Mediation Canceled Trial to Come

SDNY COURTHOUSE,
Jan 5 – Makeup company SiO
sued Oia Skin for trademark
violation. Then the defense
lawyer recorded his
conversation with SiO's
counsel.
On January
5 U.S. District Court for the
Southern District of New York
Judge P. Kevin Castel held a
proceeding. Inner City Press
covered it.
Oia Skin's
lawyer Timothy C. Parlatore
had filed a letter
transcribing and quoting Sio's
counsel Toby Butterfield on
"whether the promises that you
guys are gonna make are gonna
be in the form of a stipulated
injunction or not and whether
you're still gonna come
through with a payment to our
clients to cover their fees
for having to pursue
this."
Butterfield said this was
selective quoting. But the
mediation is off.
Judge Castel
recounted that he held held
trial even amid COVID, and is
prepared to do so
again. I'm
here to try cases, he said.
He asked that a
pre-motion letter be filed
later in the day, after having
So Ordered that "I will not
stand in the way of the
parties' irrational desire to
prolong this litigation and
run up more fees."
