SDNY COURTHOUSE,
Oct 14 – On
December 13, 2015 Daniel Lerma
was injured while repairing a
crane on a barge - while
standing on another barge, in
the navigable waters of San
Diego.
A lawsuit
ensued.
On October
14 U.S. District Court for the
Southern District of New York
Judge Katherine Polk Failla
held a proceeding. Inner City
Press covered it.
Judge Failla
inquired in California or New
York law would apply.
California, she
was told. She asked if this
was a "shore-side repair,"
given that Lerma was on one
boat, fixing another.
A motion to
dismiss is due on November 23,
and reply January 4, 2021.
