SDNY COURTHOUSE,
May 25 – Stephen Gannon sued
Great World Enterprises Inc.
and a bodeda of which it is
the landlord, under the
Americans With Disabilities
Act.
On May 25, U.S. District Court
for the Southern District of
New York Magistrate Judge
Sarah Netburn held a
conference. Inner City Press
covered it.
The defense
lawyer complained that
plaintiff's counsel may only
be trying to rack up attorneys
fees. He noted the request for
class action status, saying
that a commitment to repair
the slope of the entrance
already existed.
Judge
Netburn noted that if it is
converted into a class action,
it would require disclosure
and review of any settlement.
Plaintiff's counsel said he
will only move for class
certification if there is not
a settlement. A status letter
is due on September 9.
