SDNY COURTHOUSE,
Sept 2 – Diego B.
Rodriguez was given a life
sentence for the murder and
burning of a victim in The
Bronx in 1999. On September 2
.S. District Court for the
Southern District of New York
Judge Jed S. Rakoff held a
"compassionate release"
proceeding. Inner City Press
live tweeted it:
AUSA: Living a
model life in in prison
doesn't merit release, given
the seriousness of his
offense. In his pro se papers
he claims he is factually
innocent. Judge Rakoff: I have
vivid memories of this trial.
Mr. Rodriguez was very much
involved.
AUSA: He now
claims he was just copying and
pasting from a clemency
submission. But he's tried
many times, to get out from
his life sentence.
Judge Rakoff:
It's called compassionate
release. It contemplate
release of those with serious
crimes.
Judge Rakoff says
he won't decide this without
further through, won't be
ruling today.
Still, Inner City
Press plans to write a short
articles later today, then
another when Judge Rakoff
rules.
The case is US v.
Diego B. Rodriguez, 00-cr-761
(Rakoff)
