Release Sentencing in SDNY

SDNY COURTHOUSE,
March 30 –
Angel Suarez was
up for sentencing on
violations of supervised
release, but a Bronx
hit-and-run arose at the
sentencing.
On March 30 in the U.S.
District Court for the
Southern District of New York,
now Second Circuit Judge
Richard J. Sullivan held the
VOSR proceeding. Inner City
Press covered it.
Judge
Sullivan zeroed in on the hit
and run, saying whatever the
NYPD and Bronx DA do about it,
Suarez violated his Federal
supervised release by not
telling Probation about his
contact with law enforcement.
The
Assistant US Attorney,
ascribing the information to
NYPD, said that Suarez hit
someone with his car on the
Bruckner, then fled and
quickly reported that the car
had been stolen and he had
been at home.
But NYPD said his
cell phone shows he was on the
Bruckner.
Suarez'
lawyer said this was
after-arising information and
that the sentencing should be
forward without it.
Judge Sullivan
disagreed, and asked for a
letter in two weeks. He told
Suarez not to undermine his
letter with courtroom
behavior. He thanked the
Marshals, and adjourned the
proceeding.
