SDNY COURTHOUSE,
Oct 18 – Anthony Diaz was
driving when his car was hit
by a rented Ryder truck on
181st Street and Amsterdam
Avenue in Upper Manhattan on
April 8, 2018.
He sued in
state court and it was removed
to Federal court.
On October 16
U.S. District Court for the
Southern District of New York
Judge Gregory H. Woods held a
proceeding. Inner City Press
covered it.
The talk was of
the rental agreement, Diaz'
second surgery - and the
Graves amendment, which
preempts all state statutory
and common law to the extent
those laws hold owners in the
business of renting or leasing
motor vehicles vicariously
liable for the negligence of
drivers. Or so Ryder says.
