Swipe Seller Sues For Arrests Citing
Disparate Treatment Now Case Law in SDNY

SDNY COURTHOUSE,
May 26 – Peter Delgado was
arrested three times in 2018
for allegedly selling
MetroCard swipes in NYC subway
stations. He says white
swipe-sellers were treated
better - and he has
sued.
On May 26, U.S.
District Court for the
Southern District of New York
Judge John P. Cronan held a
proceeding. Inner City Press
covered it.
There was
talk that Delgado might have
been detained for panhandling;
the response was that the
record does not support that.
Judge
Cronan called the equal
protection argument
interesting and asked for case
law.
Now he has
given the parties five days to
submitted letters on the
topic.
The case is
Delgado v. City of New York et
al., 19-cv-6320 (Cronan)
