SDNY COURTHOUSE,
April 29 – Citing publication
of photo of the EMMY statuette
holding the COVID-19 ball, The
National Academy of Television
Arts and Sciences has sued
Crowdsourcing the Truth.
On December 3,
U.S. District Court for the
Southern District of New York
Judge Valerie E. Caproni tells
a discovery dispute
conference. Inner City Press
called in and live tweeted it,
here:
Judge: Has there
been a protective order
entered in this case?
TV Academies'
lawyer: We thought there was
an agreement. But they're
going to show the discovery to
these conspiracy theory fans.
And try to get more YouTube
views.
Judge: This
is very unorthodox. Why is it
appropriate?
Crowdsource
the Truth lawyer: We'll get
volunteers. Otherwise it's too
expensive to review. But I
haven't seen the discovery
yet.
Judge: That's not
an adequate explanation. What
about home addresses?
Crowdsource the
Truth lawyer: They would agree
not to disclose
addresses.
Judge: So you're
going to hire
them?
Crowdsource the
Truth lawyer:
Volunteers.
Judge: These are
not paralegals. I am
precluding this without you
coming back to me. OK, 3d
party subpoenas These too will
be limited, or require
pre-approval.
On December 10,
the parties wrote to SDNY
Magistrate Judge Ona T. Wang
that Crowdsourcing the Truth
"tendered a settlement
offer... rejected by email on
December 9."
Now on April 28,
District Judge Caproni held
another conference, and Inner
City Press again covered it. A
complaint was made about the
lack of information about the
second Crony Awards.
Afterwards, Judge Caproni
ordered:
"1. Defendant's
revised responses to requests
to admit and revised amended
verified interrogatory
responses to Plaintiff's first
set of interrogatories are due
by May 5, 2021. 2. Defendant
must provide at least three
dates on which Defendants
deposition may be taken by May
5, 2021. All three dates must
be after May 12, 2021. By the
same date, Plaintiff must
provide Defendant with at
least three dates on which
Plaintiff's Rule 30(b)(6)
deposition may be taken. 3.
Defendant's revised responses
to requests for production,
including results of the
searches using the search
terms specified in Plaintiffs'
April 21, 2021 letter to
Defendant, are due by May 5,
2021. Documents to be included
in that production include
documents responsive to
Requests 11 and 12 from
Plaintiffs initial requests
for production. 4. Defendant's
responses to Plaintiffs Second
Set of Interrogatories and
Requests for Production is due
April 30, 2021. 5. Plaintiff's
amended complaint to add only
a claim for attorneys' fees
must be filed by May 7, 2021.
Plaintiff must file both a
red-lined copy of the amended
complaint and a non-redlined
copy by that date. 6. The fact
discovery deadline is extended
to May 21, 2021. 7. A pretrial
conference will be held on May
21, 2021 at 11:30 a.m." Watch
