to Bronx Simpson Street Kidnapping Stalls
On Lack of Pimentel Letter in SDNY

SDNY COURTHOUSE,
Jan 21 – Joseph Davila was
prepared on January 21 to
plead guilty to kidnapping,
for an incident on Simpson
Street in the South Bronx in
March 2019 - but it did not
happen.
On January 21, U.S. District
Court for the Southern
District of New York Judge P.
Kevin Castel had scheduled a
change of plea proceeding.
Inner City Press covered
it.
But it soon
emerged that the US Attorney's
Office had not provided Davila
through his attorney with a
Pimentel letter about their
calculation of the sentencing
guidelines.
Judge
Castel said he could not
proceed this way, and demanded
to know how this had happened.
The AUSA
did not have a reason, but
apologized. Judge Castel in
turn apologized to the
Marshals and the CJA fund and
presumably others.
The plea, one
assumes, will be re-scheduled.
