SDNY COURTHOUSE,
March 2 – Jeremy Ortiz-Molina
is charged with agreeing to
sell eight kilograms of meth
to a confidential source.
On March 1
U.S. District Court for the
Southern District of New York
Magistrate Judge ordered him
freed pending trial, on
$150,000 bond.
The US Attorney's
Office for the SDNY
appealed. On
the afternoon of March 2, SDNY
District Judge Jesse M. Furman
heard the appeal, de novo.
Inner City Press covered
it.
The
Assistant US Attorney said
there was no way to stop the
defendant from arranging such
drug deals, as long as he has
accept to a phone.
Judge
Furman, while commenting on
the significant weight of meth
alleged, said there is no real
danger of flight or risk of
non-appearance, given
Ortiz-Molina's connections to
Florida.
He upheld
Magistrate Lehrburger's
decision; he cited the
defendant's parents and
fiancee.
The AUSA
did not indicate any plan to
appeal to the Second Circuit
but did argue that
Ortiz-Molina and his
also-charged son should not
have the same bond co-signers.
Judge Furman said
that could be taken up with
the Magistrate Judge on
duty.
The case is US v.
Ortiz-Molina, 21-mj-2260
(Furman)
