Pleads To Cocaine and Crack With Guideline
at 24 Months, Sped Up Sentencing

SDNY COURTHOUSE,
July 13 – Franmy Luna
was charged with conspiracy to
distribute powder cocaine and
crack.
On July 13, U.S. District
Court for the Southern
District of New York Judge
Paul G. Gardephe held a change
of plea proceeding. Inner City
Press covered it.
Luna said
he went to school through the
fourth year of high school. He
initially allocuted only to
cocaine, but after AUSA
insisted, added crack.
Judge Gardephe
was going to set sentencing
for November 15, but Luna's
counsel pointed out that he
had almost served the time at
the lower end of the guideline
in the plea agreement (which
specifies 24 to 30 months).
So the
sentencing was moved up to
October 5.
