SDNY COURTHOUSE,
Sept 26 -- Pilar Salas of the
Bronx sued The Bagel Tree of
245 East 124th Street in
Manhattan under the Fair Labor
Standards Act - then
settled.
On
September 25 U.S. District
Court for the Southern
District of New York Judge
Lewis J. Lewis held a fairness
hearing. Inner City Press
covered it.
The
individual defendants, it
seemed, were not present. But
their lawyer Giacchino Russo
explained how the settlement
was reasonable. Salas' lawyer
Jacob Aronauer explained why
taking one-third of the
settlement was fair, less than
the $350 an hour he would have
charged.
Judge Liman to
his credit inquired into why a
general released was
necessary. But Ms. Salas, when
asked, said she agreed to it.
She added that
she only sued due to family
circumstance that had made it
she couldn't get another
job. Judge Liman
wished her well, and said he
found the settlement fair.
The case is, or
was, Salas v. 124 Street
Market, Inc. et al.,
19-cv-11007 (Liman)
