SDNY COURTHOUSE,
Oct 25 – Ricardo Ortiz sued
Cafe Tabaco & Ron at 501
West 214th Street in Upper
Manhattan for failure to pay
overtime.
On August
23, 2022 U.S. District Court
for the Southern District of
New York Magistrate Judge
Katharine H. Parker held a
proceeding. Inner City Press
covered it.
There was
talk of possible sanctions,
and discovery violations.
One counsel asked
that the case continue by
telephone until the time of
trial, since he lives in and
works out of the Poconos in
Pennsylvania.
A formal
motion for sanctions is due by
September 9. There was a next
conference on October 24 at 11
am - and Inner City Press
covered it.
Judge Parker
addressed the acts of Ismael
Garcia, who did not show up
for deposition - she found the
amount of sanctions requested
excessive, but awarded "only"
$450 an hour for partner time,
for $825.
The case is Ortiz
et al v. Eskina 214 Corp. et
al., 21-cv-1537 (Carter /
Parker)
