SDNY COURTHOUSE,
Oct 12 – Ideavillage
Products sells its
"copper-infused compression
garments" through "As Seen on
TV" marketing. When Copper
Compression Brands LLC started
buying up the keywords Copper
and Fit on Amazon, Ideavillage
sued.
On October
9 U.S. District Judge for the
Southern District of New York
Katherine Polk Failla held a
proceeding. Inner City Press
covered it.
Judge Failla
expressed surprise that
copper, being ten or twelve
words away from "fit," was
still viewed as actionable.
She asked about the
applicability of the Polaroid
factors.
Finally, Judge
Failla directed the parties to
contact SDNY Magistrate Judge
Katherine H. Parker or of
before November 13 to try to
settle the matter.
