University Is Sue For Keeping Tuition Amid
COVID Already Lost 1 Motion in SDNY

SDNY COURTHOUSE,
March 18 – Xaviera
Marbury paid Pace University
for tuition - for in person
teaching - and room and board
for the Spring of 2020.
Then COVID hit,
and Pace refused to pay the
tuition back. Marbury sued.
On March
18, U.S. District Court for
the Southern District of New
York Judge Jesse M. Furman
held a proceeding. Inner City
Press covered it.
Judge
Furman had already denied one
of defendant Pace's motions,
and genially chided their
lawyer for perhaps not having
pleaded it correctly.
Now the question
is the scope of discovery, how
much it should just be limited
to "public facing" materials.
Motions are due April 1, with
fact discovery to end August
6. There will be another
conference on August 10.
Judge
Furman raised the possibility
of private mediation, or the
SDNY Magistrate or Mediation
Program.
