SDNY COURTHOUSE,
Sept 28 – Christopher Seminara
sued AKO Builders and Home
Improvements Inc. in a wage
dispute under the Fair Labor
Standards Act.
On
September 28, 2022, U.S.
District Court for the
Southern District of New York
Magistrate Judge Sarah Netburn
held a proceeding. Inner City
Press covered it.
Judge Netburn
said frankly, it is not a high
value case, that her estimate
put the damages at less than
$10,000. She was told of a
willingness for mediation -
but said even that might be
out of proportion.
The filed case
management plan envisions any
motion for summary judgment by
February 22, 2023, and if
unsuccessful, a bench trial.
That seems unlikely.
The case is
Seminara v. AKO Builders and
Home Improvements Inc., et
al., 22-cv-5079 (Engelmayer /
Netburn)
