JDS Was Sued For American Copper Building Now Files Settlement in SDNY

SDNY COURTHOUSE, March 5 – NYC luxury housing developer JDS is being sued for alleged Fair Housing Act violations on two large buildings: American Copper (760 expensive rentals at 626 1st Ave) and 202 8th Street in Park Slope, Brooklyn.  

  U.S. District Court for the Southern District of New York Chief Magistrate Judge Gabriel W. Gorenstein held a proceeding on June 15. Inner City Press covered it.

  Judge Gorenstin told a defense lawyer, You didn't answer my question. If you understand that you didn't, please do. Or I can repeat my question.     The question was about discovery, and whether two people affiliated with the defendants used private email addresses. 

   Judge Gorenstein told plaintiff he would facilitate a subpoena for these disputed private emails, including "what time they wake up in the morning."   

  But it was said PMG (Property Markets Group) has owed these documents for a long time. 

  Judge Gorenstein said, We're going down the subpoena route, and it could get "intrusive."

Now on March 5, counsel for the Fair Housing Center has filed a letter with District Judge Analisa Torres, "the parties have now completed and executed a settlement agreement... Paragraph 62 of the proposed settlement agreement provides that the Court will retain jurisdiction over the monetary and remediation aspects of the settlement."

The case is Fair Housing Justice Center, Inc. v. JDS Development LLC et al., 19-cv-1171 (Torres / Gorenstein).
