Fees Exceed One Third So SDNY Judge Fox Asks
To See Retainer

SDNY COURTHOUSE,
Nov 27 – Yihan Spa at 926
Second Avenue in Manhattan
stiffed its eight employees of
overtime, a lawsuit being
settled asserted. But there's
a problem with the settlement.
The one-third
devoted to attorneys fees
seemed to include too many
filing fees. On June 24
U.S. District Court for the
Southern District of New York
Magistrate Judge Kevin N. Fox
held a proceeding. Inner City
Press covered it.
The
plaintiffs' attorney - he
seemed unsure how many
plaintiffs he represented --
found it difficult to explain
taking more than $15,000 of a
$45,000 settlement.
Judge Fox zeroed
in on it, and has requested to
see the retained agreement.
The case is Yin
et al v. Caribbean Bluewaters
Group, LLC et al., 19-cv-2032
(Fox).
