SDNY COURTHOUSE,
Jan 3 – As part of a new
flurry of cases under the
Americans with Disabilities
Act, Yovanny Dominguez has
sued SoulCycle for failing to
sell store gift cards that
contain writing in
Braille.
On
February 6, SoulCycle's lawyer
Rebecca M. McCloskey of
Jackson Lewis P.C. called it
an untested theory with a
boilerplate complaint.
With a
courtroom gallery empty except
for Inner City Press, U.S.
District Court for the
Southern District of New York
Magistrate Judge Robert W.
Lehrburger expressed interest
in the theory.
He agreed,
however, to stay discovery
pending a motion to dismiss.
SoulCycle' counsel Ms.
McCloskey complained that SDNY
District Judge Laura Taylor
Swain has not responded to her
pre-motion letter. The case is
Dominguez et al. v. SoulCycle,
Inc., 19-cv-10816 (Swain /
Lehrburger).
