Man Who Got COVID On Rikers Island Sued City Now Told To Amend to Address Monell

By Matthew Russell Lee, Patreon Maxwell Book
BBC - Guardian UK - Honduras - ESPN

SDNY COURTHOUSE, Feb 9 –  Duane Morris got COVID while in Rikers Island and sued the City of New York.

On Feb 9, U.S. District Court for the Southern District of New York Judge Lorna G. Schofield  held a proceeding. Inner City Press covered it.

Judge Schofield explained that to make out a Constitutional violation is difficult and urge Morris to amend his complaint, saying she would fill in the law. She told the City's lawyer she expected him to file a motion under Monell and 12(b)(6), thirty days after the amendment.

This case is Morris v. City of New York, 21-cv-8930 (Schofield).

It may be contrasted, or viewed in conjunction with, a similar case Inner City Press recently covered presided over by Judge Lewis J. Liman

Judge Liman left the parties on the line, but said explicitly that the public had a right to stay on the line.

Inner City Press, but voluntarily limits it reporting to noting that even after the plaintiff said he was uncomfortable continuing to answer questions since he didn't have a lawyer, he was told that settling it more convenient than litigating, and that some information will be sent to him.

That case is Andretta v. City of New York. 21-cv-5783 (Liman)
