SDNY COURTHOUSE,
Feb 9 – Duane Morris got
COVID while in Rikers Island
and sued the City of New
York.
On
Feb 9, U.S. District Court for
the Southern District of New
York Judge Lorna G.
Schofield held a
proceeding. Inner City Press
covered it.
Judge
Schofield explained that to
make out a Constitutional
violation is difficult and
urge Morris to amend his
complaint, saying she would
fill in the law. She told the
City's lawyer she expected him
to file a motion under Monell
and 12(b)(6), thirty days
after the amendment.
This case
is Morris v. City of New York,
21-cv-8930 (Schofield).
It may be
contrasted, or viewed in
conjunction with, a similar

Judge Liman
left the parties on the line,
but said explicitly that the
public had a right to stay on
the line.
