Man Sued NYPD Officer and Screamed He Was Abused as He Fished but Jury Ruled against Him

SDNY COURTHOUSE, August 9 – Boisey Caldwell sued NYPD Officer Geronimo German for abusing him while he was fishing in Morningside Park.  

 On August 1, 2022 U.S. District Court for the Southern District of New York  Magistrate Judge Sarah L. Cave held a near final pre-trial conference. Inner City Press covered it.  

The NYC Corporation Counsel lawyers did not want to be referred to as such as trial, or as representing the City, only German.

Judge Cave said she'd have to inquire about Corporate Counsel during jury voir dire, but that during the trial the lawyers should be referred to by name, or as plaintiff's counsel and defense counsel.   A final final pre-trial conference was set for August 5 at 5 pm.

And it took place at 5 pm, after a letter mailed in by Caldwell (photo here); it was said that won't happen again. The defense does not want the plaintiff's condition(s) described to the jury. Both sides agreed it will be a two to three day trial.

On August 8 Inner City Press went to the 23rd floor to report on Caldwell's direct and especially cross examination. The direct was unique, asking the client to just stick to the facts. The cross made him upset, with the City's / officer's attorney insisting there had been a no fishing signed and that Caldwell believes he can do whatever he wants.

 Caldwell, in the enclosed COVID times witness box, insisted there was not a no fishing and that the officer abused him, lacerating his chin. He stood up and yelled, I am brown skinned, they are killed us! The Court wisely called a recess.

On August 9, Officer Geronimo was on the witness stand. His lawyer played video of the incident, emphasizing that he didn't put his knee on Caldwell, and even said "It's OK." Caldwell's arms got pulled behind his back, and he was in the precinct for an hour bleeding before sent to a hospital. (Geronimo said it was because he refused treatment).

  Geronimo said he's seen Caldwell in Morningside Park three times since, once with two little girls; he grabbed Caldwell and told him that he (and all others) couldn't enter the park.

At day's end, Judge Cave was reading the jury her legal charge.

And in the end, the "jury found in favor of Defendant... It is hereby Ordered, Adjudged and Decreed that... the Complaint is hereby dismissed." The Judgment was docketed on August 11.

The case is Caldwell v. Officer German Geronimo, 19-cv-8253 (Cave)
