Store Sale Triggers Claims of Bad Faith on
Discovery Unopened Email Notices

SDNY COURTHOUSE,
Nov 15 – The sale of an
Aaron's rent to own store in
State College, Pennsylvania
has given rise to discovery
disputes, lost emails and
accusations of bad
faith.
On November
13 U.S. District Court for the
Southern District of New York
Judge Katherine Polk Failla
held a proceeding. Inner City
Press covered it.
The
plaintiff's / seller's
attorney complained that his
emails and calls weren't
returned, and that he had not
been provided initial
disclosures.
Judge
Failla inquired into the
specifics of defense counsel's
email practices.
He said he
gets the NEF or Notice of
Electronic Filing emails but
doesn't open them the same
day.
I wish you
hadn't told me that, Judge
Failla said. Still, she
declined to award sanctions,
saying she hoped it was
figured out.
