Spam Texts From Curaleaf Get Sued Under
TCPA Now Dismissal Ruling This Month

SDNY COURTHOUSE,
Nov 5 – Curaleaf sells
cannabis - including using
automated text messages.
They've been
sued.
On November 5
U.S. District Court for the
Southern District of New York
Judge Jed S. Rakoff held a
half-hour oral argument. Inner
City Press covered it.
Counsel for
plaintiff Katherine Brooks had
sued under the Telephone
Consumer Protection Act, about
Curaleaf's text messages like
"Curaleaf dispensaries are
open for in-store shopping
June 15. Purchaes sof $100+
receive BONUS CuraCredits."
This was
repeatedly sent to the
plaintiff, from different
phone numbers.
On the
motion to dismiss, Judge
Rakoff said he would try to
rule by the end of November
(he is presiding over the
criminal jury trial of MiMedx'
Parker Petit and Bill Taylor,
which Inner City Press is also
covering).
