SDNY COURTHOUSE,
Dec 10 – Robert Koch
pleaded guilty to "pump and
dump" security fraud in 2010.
Thereafter Caro Capital LLC
hired him but only to work on
"discrete, one-off project
that were not prohibited by
Koch's criminal
history."
Then came Brian
John, Richard Miller and ther
Jupiter Wellness, Inc. seeking
to go public selling
cannabidiol CBD sunscreen and
eczema treatments.
They dumped
Koch, knowing that his
conviction would undermine
them selling
securities. But,
they claim, Koch then tried to
extort them for $9 million.
They sued.
On October
8, 2020 U.S. District Court
for the Southern District of
New York Judge Lewis J. Liman
held a proceeding. Inner City
Press covered it.
Judge Liman said
all depositions must be
completed by March 5, and to
be ready for trial by July 30,
with a three day trial
anticipated.
On December 29,
SDNY Magistrates Judge Sarah
L. Cave held a proceeding,
which Inner City Press also
covered. Koch has filed a
counter-claim to recover
damages. Caro Capital's lawyer
said they see no merit and do
not anticipate making any
settlement offer on them,
pointing to their pending
motion for judgment on the
pleadings.
Still,
Judge Cave set up a session to
attempt to settle, on February
10, 2021; she said the parties
could set up a Zoom or WebEx
connection, or use the Court's
AT&T phone line. A dog
barked, and happy New Years
was wished.
Jump cut to
August 9, 2021. District Judge
Lewis J. Liman held a
proceeding, and Inner City
Press covered it. There have
been motions to dismiss the
second amended counterclaim.
On December 10
Judge Liman held another
conference in the case and
Inner City Press again covered
it. Judge Liman ordered the
parties to file simultaneous
letters by December 17. Watc
