SDNY COURTHOUSE,
Jan 26 – The son of Abdulwali
Saleh was injured in the
building of Burlington Coat
Factory Warehouse on Webster
Avenue in The Bronx on July
26, 2020. The father
sued.
On January 26,
U.S. District Court for the
Southern District of New York
Judge John G. Koeltl held a
proceeding. Inner City Press
covered it.
Judge
Koeltl asked why discovery was
scheduled to take so long. The
defense' response was that due
to COVID, there is much delay
in HIPPA releases.
The
plaintiffs' lawyer said the
only holder of medical
recortds is Montefiore
Hospital, and they have
already been requested.
Judge Koeltl
moved up the deadlines and
said, I have said you five
months. He said he prefers
that discovery disputes come
to him, and not a Magistrate
Judge, as he thinks it makes
the parties act better. He
made a referral to
mediation.
