Arbitration So Injunction Denied in SDNY

SDNY COURTHOUSE,
June 13 – James F. Flaherty
was working at Colony Capital
when he was accused of sexual
harassment.
He believes
Colony should indemnify him in
connection with an upcoming
arbitration. Colony sued
seeking to enjoin the June 14
arbitration proceeding.
On June 11, U.S. District
Court for the Southern
District of New York Judge
Alison J. Nathan held a
proceeding. Inner City Press
covered it.
Colony, it
emerged, knew of the
arbitration since May 2020 but
only recently filed its case
in SDNY.
Judge Nathan
ruled that their timing was
unfair to Flaherty and to the
Court.
She denied the
preliminary injunction and the
arbitration will go forward.
