Cosmetics at Macy's Gave Ocular Herpes
With Tester Makeup Customer Says In SDNY

SDNY COURTHOUSE,
Dec 16 – Temmeka Hill went to
Macy's and the MAC Cosmetics
counter; she had eyeliner
applied to her eyelids.
But it was
tester makeup that had been
used on others and she got
ocular herpes. She sued.
On
December 16 U.S. District
Court for the Southern
District of New York Judge
Paul A. Engelmayer held a
proceeding. Inner City Press
covered it.
Judge Engelmayer
asked, sensibly, it was
possible to get herpes from a
make-up counter. He was told,
"Anything is possible."
It did not make
him happy. Nor did multiple
passings-of-the-buck to a
partner who was not
present.
In the
docket this month: plaintiff
made a settlement demand of $3
million.
So depositions
are to be completed by June
16.
The case is Hill
v. M.A.C. Cosmetics Inc. et
al., 20-cv-9609 (Engelmayer)
