30 Years For Crack Now Seeks Relief Under
First Step Act Pro Se in SDNY

SDNY COURTHOUSE,
Dec 10 – Nelson Martinez was
convicted by a jury of crack
conspiracy in 2007 and got 360
months.
This was reduced
to 324 months, then to 288
months under the First Step
Act.
On
December 2, 2020 U.S. District
Court for the Southern
District of New York Judge Jed
S. Rakoff held an oral
argument on his motion for
compassionate release. Inner
City Press covered it.
Martinez
was represented by Debevoise
& Plimpton.
They described
155 inmates at FCI Loretto
sharing five bathroom stalls,
and sharing phones and
computers. He has type II
diabetes.
Judge
Rakoff on December 4, 2020
ordered Martinez released.
A year later
co-defendant Nathaniel Slater
has, pro se, requested a
reduced sentence under Section
404 of the First Step Act. He
was sentenced to 30 years for
50 grams of crack. Now a
process has begun.
