Exclusionary Zoning and
Commerce Clause Arise in Developer's Lawsuit

SDNY COURTHOUSE,
June 2 – Real estate developer
Steven M. Sherman in 2012 sued
the Town of Chester, New York,
in state court. It got removed
to Federal
court.
On June 2, U.S. District Court
for the Southern District of
New York Judge Edgardo Ramos
held a proceeding. Inner
City Press covered
it.
The
plaintiff's lawyer went big
picture, talking about
exclusionary zoning and the
dormant Commerce Clause.
Judge Ramos
was skeptical, noting that
this was not what the case was
initially about.
He said he
couldn't stop the plaintiff
from filing a motion to amend,
and gave until June 23 to do
so.
The case is
Sherman v. Town of Chester et
al., 12-cv-647 (Ramos)
