SDNY COURTHOUSE,
Feb 18 – Kye Sun Kang
was working at Bloomingdale's
on Third Avenue in Manhattan
on April 19, 2017 when she was
arrested.
She was
"informed that one of her
Chinese clients, Mr. Kevin
Chen, made purchases using
fraudulent Bloomingdale's
credit
cards."
The charges were
dropped on September 29, 2017
- and Kang sued Bloomingdale's
and L'Oreal.
On
February 18 U.S. District
Court for the Southern
District of New York Judge
Valerie E. Caproni held a
proceeding. Inner City Press
covered it.
There was
discussion of why Kang and not
her non-Asian co-workers had
been suspected. Ultimately
L'Oreal's motion for summary
judgment was denied in full,
and Bloomingdale's had its
partially denied.
The parties have
to specify expert discovery by
March 5, and also say if they
would like a referral to
Magistrate Judge Moses.
The case is Kang
v. L'Oreal USA, Inc. et al.,
18-cv-11682 (Caproni)
