Man Charged
With Crystal Meth Gets Extra Day Out Via
Prosecutors Who Want the Why Sealed

SDNY COURTHOUSE,
April 12 – Thomas Bistritz is
charged with crystal
meth.
On
April 12, U.S. District Court
for the Southern District of
New York Judge P. Kevin Castel
held a bail review hearing.
Inner City Press covered
it.
Bistritz's
lawyer acknowledged his
client's crystal meth problem,
but argued to keep him from
being remanded. Ultimately he
was unsuccesful.
But when Judge
Castel ordered that Bistritz
turn himself in on April 13,
Assistant US Attorney Samuel
P. Rothschild atypically asked
that it be delayed to April
14.
When Judge
Castel understandably asked
"Why" AUSA Rothschild mused
that a confidential or sealed
sidebar was not possible but
he might ask to seal the
transcript after the
fact. Judge Castel to
his credit said that would not
be possible.
As Inner City
Press has repeatedly asked,
what sense does it make to
retroactively sealing
something said in open court?
But then
Bistritz's lawyer said he
consented and so it was
ordered, still with no reason
given. The docket in the case
is replete with "Order(s) to
continue in the interest of
justice."
