SDNY COURTHOUSE,
June 3 – Francisco Emerterio
sued Remedy Diner for unpaid
overtime, seeking to have it
declared a collective action.
On June 3,
U.S. District Court for the
Southern District of New York
Judge Jesse M. Furman held a
proceeding. Inner City Press
covered it.
Judge
Furman gave a short extension
of the time to take
depositions, to July 1, but
said, that's it.
He said it will
not be a collective action.
The defense then asked him to
confirm they do not have to
produce more discovery.
He suggested that
both parties produce anything
that was previously requested,
to lessen the possibility of
sanctions being awarded.
The case is
