SDNY COURTHOUSE,
July 21 – A man from Honduras
has challenged his detention
after a US Board of
Immigration Appeals
decision.
On July 21, U.S. District
Court for the Southern
District of New York Judge
Alison J. Nathan held an oral
argument. Inner City Press
covered it.
Judge
Nathan questioned the
petitioner's counsel at
length, then ordered that
within seven business day a
new individualized bond
hearing must be held, with the
Government having the burden
to demonstrate that the
petitioner is a flight risk or
a danger to the community. His
ability to pay and alternative
conditions of release must be
taken into account hwen
setting bond.
If there is
no hearing in seven business
days, he must be released.
