East Village Cafe Was Sued
Under ADA So Demanded Plaintiff's 1099s Now A
Stipulation

SDNY COURTHOUSE,
Oct 12 –
Ashley Francis sued Tompkins
Square Acquisition LLC and
Seven A Cafe for being
inaccessible to the
disabled.
On
August 24 U.S. District Court
for the Southern District of
New York Judge John P. Cronan
held a proceeding. Inner City
Press covered it.
As issue
was the defendants' request
for Ms. Francis' tax returns
or at least 1099s.
They are alleging
that she just goes to
businesses stoops and sues -
then possibly doesn't pay
taxes.
Her lawyer said
it is not relevant but
collateral.
But Judge Cronan
ordered that the 1099s be
produced, albeit with the
names of the previously
settlement businesses
redacted.
Another
proceeding was held on October
12, and Inner City Press again
covered it. But the 1099s had
still not been produced. Now
the plaintiff's lawyer asked
if opposing counsel would
disclose whether in previous
cases their clients had issued
1099s.
On November 16,
Judge Cronan held a proceeding
about a stipulation and order
between the plaintiff and Tompkins
Square
Acquisition
LLC involving
some 2010 ADA
modifications.
