SDNY COURTHOUSE,
June 2 – Fertility doctors for
water damage sued the co-op
board of 55 Central Park
South.
On December
16, 2020 U.S. District Court
for the Southern District of
New York Judge Jed S. Rakoff
held his sentencing. Inner
City Press covered
it.
The doctors
put forward a photo of their
entrance, and board minutes
and an email.
Still, there are
over-broad discovery demands,
and the scope of an upcoming
deposition, two hours in
length, has been limited.
On January 15,
Judge Rakoff held an oral
argument. Inner City Press
called in to cover it. First
the AT&T line was "locked
by host," which Inner City
Press hears too frequently.
But after a simple inquiry it
was opened, much better than
in some other cases.
The
defendants are saying that the
real parties in interest in
the case are Professional
Corporations and that there is
no diversity jurisdiction.
Judge Rakoff questioned them
about it.
On April 22,
Judge Rakoff held a final
pre-trial conference. The
parties were told about
TrialGraphix, and that they
could submit videos for Judge
Rakoff to watch during the
evenings during the trial.
On June 2, before
opening arguments, Judge
Rakoff inquired into the speed
with which the transcripts
will be available. He said he
wants to rule soon after the
trial ends, while the
credibility of witnesses is
still fresh in his mind.
Judge
Rakoff chided counsel for
making state court objections
like "self-serving." Then it
began, about the leaks, and an
architect witness. Watch this
site.
The case is
Kofinas et al v. Fifty-Five
Corporation et al., 20-cv-7500
(Rakoff)
