SDNY COURTHOUSE,
Sept 6 – Jasmine Burgess sued
Major Model Management for not
paying her minimum wage.
On December
1, 2020 U.S. District Court
for the Southern District of
New York Judge Gregory H.
Woods held a proceeding. Inner
City Press covered
it.
The modeling
agency says it was up to
Burgess to find work. Judge
Woods inquired into whether
the contract was with Burgess
or her LLP.
Her lawyer said
she set up an LLP because she
heard it was the thing to do,
but hasn't used it.
On February 1,
2021 Judge Woods held another
proceeding, and Inner City
Press again covered it. The
defendant is saying the claims
are inconsistent, alleging
employer / employee
relationship and then denying
it. Judge Woods said to file
the motion to dismiss by
February 25.
On March
28, Judge Woods denied the
motion to dismiss. On June 8
he held another conference and
Inner City Press again covered
it. Discovery is proceeding
(the class excluding current
models).
On October 5,
Major Model Management's
lawyers quit. In a proceeding
covered by Inner City Press,
they offered to show Judge
Woods in camera how many they
are owed. Judge Woods said he
accepted their proffer and let
them out of the case, giving
MMM 30 days to retain new
counsel or be found in
default.
On November 15
Judge Woods held another
conference in the case and
Inner City Press again covered
it. MMM had new counsel; its
motions to dismissed were only
partially granted so the case
proceeds, albeit with a stay
of 60 days.
On March 11, 2022
Judge Woods held another
proceeding, and Inner City
Press again covered it. MMG is
now in bankruptcy, but
individual defendant Guido
Dolce called in with an
Italian interpreter. He is
still subject to discovery,
but claims he has no personal
email account.
On April 26,
Judge Woods held another
conference and Inner City
Press ask covered it. This
time Judge Woods ordered the
case stayed, citing the
bankruptcy case In Re Major
Model Management, Inc.
22010169-mg (SDNY Bankr.).
On September 2,
2022, Judge Woods held another
conference, and Inner City
Press again covered it.
Plaintiff was ordered to
provide all discovery
responses to Guido Dolci,
individually. They were
referred to the Magistrate
Judge, with a status report
due on December 2.
