SDNY COURTHOUSE,
March 23 – TrustPilot has been
sued for trapping small
business customers into
auto-enrolling for its
services, which the
complainant calls of limited
value.
In a
complaint filed on Martin
Luther King's Day in the U.S.
District Court for the
Southern District of New York,
TrustPilot Damages LLC says
that TrustPilot was enabled by
Denmark's national investment
fund,
Vaekstfonden.
It cites
wellsfargo.com and
wellsfargo.net as examples in
the scheme.
It quotes
investigations by BBC and The
Times of London.
On March
23, the case appeared before
the assigned District Judge,
Jed S. Rakoff, presiding for
the prior weeks over the Eaze
criminal trial.
There was
talk of doing class
appropriate discovery,
separately. No, Judge Rakoff
said, he never permits such
bifurcation.
On May 5, Judge
Rakoff held another proceeding
and Inner City Press again
covered it. It concerned the
defendant's motion to dismiss
the second amended complaint.
Things are moving fast, almost
as fast as the auto-renewals
at issue.
The case is
TrustPilot Damages LLC v.
TrustPilot Inc. et al.,
21-cv-432 (Unassigned)
