SDNY COURTHOUSE,
June 18 – Ameriway Corporation
sued May Yan Chen, a customs
broker - and now wants
discovery. But it is
impossible under the law, or
regulation?
On June 16,
2022 U.S. District Court for
the Southern District of New
York Magistrate Judge Valerie
Figueredo held a proceeding.
Inner City Press covered it.
Chen's lawyer insisted that
customs law does not allow for
the requested information to
be provided, except in camera
to the
judge.
Judge Figueredo
mused aloud about other ways
the problem could be solved.
She also pushed back at
requests to file material
under seal, correctly saying
there is a presumption of
access to the press and
public. A status letter is due
on August 5.
The case is
Ameriway Corporation v. Chen
et al., 19-cv-9407 (Broderick
/ Figueredo)
