SDNY COURTHOUSE,
March 9 -- A bankruptcy appeal
before U.S. District Court for
the Southern District of New
York Judge Lewis J. Liman on
March 9 got personal, and
potentially dangers, for
appellant Victor A. Worms.
Philadephia lawyer Bruce S.
Marks at length criticized
Worms, sitting two seats away
from him in Judge Liman's
courtroom where Inner City
Press was the only media.
Marks represents one Yuri
Vladimirovich Rozhkov. He
argued among other things that
a $34,000 sanctions order was
not criminal and therefore did
not trigger full due process
protections.
Worms in his five
minutes at the end said he had
no idea that the $34,000 were
on the table. Judge Liman said
while Worms might not like
what he was about to say, he
believe he had been on notice
and had engaged in "self-help"
in not complying with the SDNY
Bankruptcy Court order of
then-Bankruptcy (now District)
Judge Mary Kay
Vyskocil.
After the
proceeding ended and Inner
City Press left, Judge Liman
issued an order calling on
Marks to by March 11 at 5 pm
file a three page letter with
cases addressed to the
question whether FRCP 27
sanctions are appropriate for
failure to obey a Rule 45
subpoena or an order related
to it, and two other
questions.
Worms is to
file his opposition by March
13. The case is entitled
Markus v. Rozhkov, 19-cv-9611
(Liman).
