In SDNY Horse Racing Follow Up Izhaki Pleads Not Guilty As SDNY Says No Victims Under Act

SDNY COURTHOUSE, May 28 – In further FBI horse racing performance enhancing drugs prosecutions, on May 28 Sarah Izhaki and Ashley Lebowitz pled not guilty before Judge Mary Kay Vyskocil of the U.S. District Court for the Southern District of New York. Inner City Press covered and live tweeted it.  

The Assistant US Attorney describing discovery, saying that It will take about a month to process and re-upload the discovery material.

There may be motion practice about the search, cell site records - so we proposed reconvening in three months, perhaps a trial date could be selected then. We're in disposition talks.    

Izhaki's lawyer said that he and his wife will be out of town in August.    

The AUSA said, We might supersede on the smuggling charges - but we won't do it if we're moving toward resolution.  

Judge Vyskocil asked, Have you identified victims under the Victims' Act? 

The AUSA replied,  No, not in the case.   

Judge Vyskocil said, = How is September 9?    

AUSA Andrew Adams said, Fine. 

 Judge Vyskocil: OK, 11 am on that day. I am excluding time under the Speedy Trial Act to complete discovery and allow time to analyze if there will be any motion. And to allow parties to negotiate, as Mr. Adams said.

This outweighs interest of public.  The case is US v. Izhaki, 20-cr-161 (Vyskocil).
