SDNY COURTHOUSE,
August 26 – Monster Concrete
was sued by "Certain
Underwriters at Lloyd's,
London" over who should pay
for injuries to construction
worker Rodrigo Rivera at 510
East 22nd Street in
Manhattan.
On August
11, 2022 U.S. District Court
for the Southern District of
New York Judge Sidney H. Stein
had proceeding scheduled at 10
am. Inner City Press called in
to cover it.
But the
parties were not on the line.
They appeared around 10:30 am,
saying they were ready for a
"tongue lashing."
Instead there
followed a Q&A including
phrases like "cross motions
are silly" and desire to have
two shots in three rounds,
referring ot motions.
Judge
Stein set a schedule:
Plaintiffs motion for
declaratory judgment shall be
filed on or before September
30, 2022; 2. Defendants'
opposition is due on or before
October 28, 2022; 3.
Plaintiffs reply to its motion
is due on or before November
18, 2022; 4. Defendants may
file a sur-reply on or before
November 28, 2022; and 5. The
Court will hear argument on
the motion on December 15,
2022, at 10:00 a.m. in
Courtroom 23A at the U.S.
Courthouse, 500 Pearl Street,
NYC.
Judge told
the parties to try to settle.
"That's not gonna happen," he
was told.
On August 26,
Judge Stein remanded the case
to state court: "CASE REMANDED
OUT from the U.S.D.C. Southern
District of New York to the
State Court - Supreme Court of
the State of New York, County
of New York. Sent certified
copy of docket entries and
remand order. Mailed via UPS
Tracking Number 1Z E22 E53 37
1005 485 2 on 8/26/2022."
The case is
