East Settles Overtime Case But No Show in
SDNY Now Fairness Lodestar Due

SDNY COURTHOUSE,
Feb 8 – Hang Chen sued Kumo
Sushi East for not paying the
minimum wage nor overtime. Now
he says the case has settled,
but the defendant did not show
up.
On February
8, U.S. District Court for the
Southern District of New York
Judge John G. Koeltl held a
proceeding. Inner City Press
covered it.
Chen's
lawyer was present, but there
was no one for the defense.
Nevertheless,
it was said that there is a
settlement agreement.
Judge Koeltl set
a February 26 deadline for
filing a letter on the
fairness of the settlement
including any application for
attorney's fees with a
lodestar calculation and
biography of plaintiff's
counsel.
The case is Chen
et al v. ABC Corp. et al.,
19-cv-3294 (Koeltl)
