EXCLUSIVE, Sept 26 - In
the U.S. District Court for
the Southern District of New
York on September 26, a
Violation of Supervised
Release presentment, detention
or bond proceeding was held by
Magistrate Judge James L. Cott
on defendant Isaiah Ellis.
Ellis, a short
man in orange Westchester
County Department of
Corrections overalls, could or
would barely speak. A
competency exam will be
ordered.
Ellis was on
supervised release on January
21, 2020 when, the Assistant
US Attorney said, he had a
loaded firearm and stolen
property worth more than
$1000, in Yonkers. Thereafter
he neglected to tell his
Probation Officer about the
arrest, and did not report to
Probation on February 18,
2020.
He was put into
Federal custody on Friday,
September 23, 2022, with
Saturday presentment said to
be waived.
On Monday
September 26, he was assigned
a new Criminal Justice Act
lawyer - he barely answered
when asked if was his
signature on the financial
affidavit.
When asked what
medication he is on, his CJA
lawyer said he (Ellis) could
not remember.
Judge Cott
invited a filing for a
competency test and said he
would provide a summary of the
proceeding to District Judge
Analisa Torres, to whom the
case was reassigned on April
11, 2022 from Judge Alison J.
Nathan after she was elevated
to the Second Circuit Court of
Appeals.
When Ellis
pled guilty to bank fraud
before Judge Nathan on
November 30, 2016, he sounded
coherent, at least in the
transcript. What has happened
since?
