SDNY COURTHOUSE,
April 3 – Alonso Banegas, a 36
year old man from Honduras,
has been detained by ICE since
August 14,
2020.
On April 2,
U.S. District Court for the
Southern District of New York
Judge Valerie E. Caproni held
a proceeding. Inner City Press
covered it.
Banegas has
testified that he and his
family have been threatened
and assaulted by members of a
criminal organization in the
Honduras (he did not say if it
was the government).
But he has a DUI.
What is the relevance? What is
the correct burden of proof,
to be borne by which side?
Judge Caproni took it under
advisement.
The case is
Banegas v. Decker et al.,
21-cv-2359 (Caproni)
